Your personal data that you share with us and that we record during your visit to our mobile application and/or website is carefully protected and processed within the scope of data security rules in force.

We protect your personal data that you allow our Company to collect in order to prevent loss, damage, and access by unauthorized persons, and we keep your data secure by taking various security measures in this regard.

INFORMATION AND CONSENT NOTICE

Pursuant to Article 10 titled "Data Controller's Obligation to Inform" of the Personal Data Protection Law No. 6698 (the "Law"), our Company, as the data controller, has an obligation to inform data subjects about the identity of the data controller, the purposes of personal data processing, the persons to whom personal data is transferred and the purposes of transfer, the legal reasons and methods of collecting personal data, and the rights of the data subject listed in Article 11 of the Law that they can direct to the data controller.

This Information and Consent Notice has been prepared in accordance with the Law, for the purpose of informing data subjects about the procedures and principles regarding the processing of personal data of our Company's customers/users and obtaining their consent for the processing of data within the scope and purposes specified in article 2.c.

a. Identity of the Data Controller

In Article 3/1 (i) of the Law, the data controller is defined as "natural or legal persons who determine the purposes and means of processing personal data and are responsible for the establishment and management of the data recording system." Article 10/1 (a) of the Law titled "Data Controller's Obligation to Inform" has also introduced the obligation to provide information to the data subject about the identity of the data controller.

Vanago may have the capacity of "data controller" under the Law due to your personal data shared with us on this website and/or mobile application as well as other platforms. In this context, the "identity of the data controller" is Vanago Teknoloji Sanayi ve Ticaret Limited Sirketi, which has been established in accordance with the laws of the Republic of Turkey; registered with the T.C. Istanbul Chamber of Commerce Registry Directorate under registration number 1091574, with its company headquarters located at MASLAK MAH. AOS 55. SK. 42 MASLAK B BLOK NO: 4 IC KAPI NO: 542 SARIYER / ISTANBUL.

b. Purposes of Processing Personal Data

Your Personal Data is processed in accordance with the personal data processing principles specified in Article 4 of the Law, based on one or more of the personal data processing conditions specified in Article 5 of the Law. In all personal data processing activities carried out by Vanago, we act in compliance with the Law and all relevant legislation requirements.

The personal data processed by our Company is as follows:

  • Identity Information: Name, surname, Turkish ID number.
  • Contact Information: Phone number, email address, address information.
  • Location Data: Real-time or static location information collected for the performance of transportation services.
  • Transaction Security Information: IP address, device information, log records.
  • Financial Information: Payment and invoice information.
  • Visual Data: Item photos uploaded through the "Find the Right Vehicle with AI" feature. These photos are analyzed by artificial intelligence to provide you with an appropriate vehicle size recommendation.

The purposes of processing your personal data are: conducting the necessary work by our business units to enable you to benefit from the services offered by our Company within the scope of personal data processing conditions and purposes specified in Articles 5 and 6 of the Law; recommending and promoting the services offered by our Company to relevant persons by customizing them according to your preferences, usage habits, and needs; ensuring the legal and commercial security of our Company and persons in business relationship with our Company; and determining and implementing our Company's commercial and business strategies. Detailed information about the purposes of processing your personal data by our Company is provided in the Privacy Policy, which you can access at www.vanago.app.

c. Personal Data to be Processed with the Explicit Consent of Data Subjects and Processing Purposes

In cases where the personal data processing conditions specified in Articles 5/2 and 6/3 of the Law are not met, your personal data may be processed with your consent given by signing this Information and Consent Notice. If you do not give consent or wish to withdraw consent you have previously given, your information will be closed to access and its use for these purposes will be terminated.

In this context, your personal data may be processed and shared for processes related to the marketing of products and services to you, and for targeting, profiling, and analysis by determining user habits within the scope of planning and execution of relevant processes to obtain the highest benefit from products and services, and for providing customized content to you.

Visual Data Processing with Artificial Intelligence: When you use the "Find the Right Vehicle with AI" feature in our mobile application, the item photos you upload are analyzed by the Google Gemini artificial intelligence service. During this analysis process, your visual data is transferred to Google Cloud servers in the United States with your explicit consent. Using this feature means that you give explicit consent to the transfer of data abroad within the scope of Article 9 of the Law. You are not required to use this feature; you can make manual vehicle selections.

d. Parties to Whom Personal Data May Be Transferred and Transfer Purpose

Your collected personal data may be shared with our business partners, suppliers (including but not limited to service-providing carriers and similar), shareholders, legally authorized public institutions and organizations, and legally authorized private law legal entities within the scope of personal data processing conditions and purposes specified in Articles 8 and 9 of the Law, for the purposes of: conducting necessary work by our business units to enable you to benefit from the services offered by our Company; sales and marketing of our Company's services through this site and/or mobile application; recommending our Company's services to you by customizing them according to your preferences, usage habits, and needs; ensuring the legal and commercial security of our Company and persons in business relationship with our Company; and determining and implementing our Company's commercial and business strategies.

e. Method and Legal Reason for Collecting Personal Data

Your personal data is collected by Vanago through different channels and in compliance with laws during your reservation request for the purpose of conducting our commercial activities and including contracts you have entered into with our Company. Your personal data may also be processed and transferred for the purposes specified in this Information and Consent Notice within the scope of personal data processing conditions and purposes specified in Articles 5 and 6 of the Law.

f. Rights of Personal Data Subject

As personal data subjects, you can submit your requests regarding your rights to us. Your request will be evaluated as soon as possible and within 30 (thirty) days at the latest, depending on the nature of your request, and will be concluded free of charge. While it is essential that no fee is requested for requests, our Company reserves the right to request a fee based on the fee tariff determined by the Personal Data Protection Board.

The rights of natural persons whose personal data is processed under Article 11 of the Law are as follows:

  • To learn whether personal data is being processed,
  • To request information about personal data if it has been processed,
  • To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
  • To know the third parties to whom personal data is transferred domestically or abroad,
  • To request correction of personal data if it has been processed incompletely or incorrectly, and to request that the action taken in this context be notified to third parties to whom personal data has been transferred,
  • To request the deletion or destruction of personal data if the reasons requiring its processing have ceased to exist despite being processed in accordance with Law No. 6698 and other relevant laws, and to request that the action taken in this context be notified to third parties to whom personal data has been transferred,
  • To object to the emergence of a result against the person himself/herself through the analysis of processed data exclusively by automated systems,
  • To request compensation for damages in case of damage due to the unlawful processing of personal data.

To exercise your rights specified in Article 11 of the Law, you can submit your request in writing or via registered electronic mail (KEP), secure electronic signature, mobile signature, or using the email address you have previously notified to our Company and registered in our system, to info@vanago.app. Your application must include: Name, Surname, and signature if your application is in writing, Turkish ID number (nationality and passport number for foreigners), residential or business address for notification, electronic mail address for notification if available, telephone and fax number, and the subject of the request.
